Terms of Service - Wingnode

Rule 1: Beneficiary Data & Responsibility

The beneficiary undertakes to provide correct data. By registering, you undertake to provide your correct name and other accurate contact details. The use of fake or incomplete data may invalidate orders or make communication impossible. By accessing your account and using your personal password, you are solely responsible for all actions performed from your account. Wingnode cannot be held liable for errors or abuses caused by the user’s negligence regarding the security and confidentiality of their account and password.

Rule 2: Web hosting service usage limitations

The website hosting service is intended exclusively for clients who host small and medium-sized sites on the equipment of Wingnode. Large, resource-heavy users are not accepted in any form (e.g. P2P communities, torrent trackers, file hosting platforms, image hosting farms, top/statistics sites, game statistics, external traffic counters, etc.). Sites that host or promote activities prohibited by Serbian law are not accepted in any form (e.g. child pornography, illegally distributed copyrighted materials, racism, phishing, spam, illegal video distribution, etc.).

Rule 3: Technical assistance for webhosting

Technical assistance for the web hosting service is free and is provided by e-mail. We do not offer configuration services such as forum installations/configurations, logo creation or other design elements, or debugging of third-party PHP applications. The client undertakes to optimize their web applications to reduce resource consumption and to respect fair-usage policies, without overloading the processing resources of the server. The client undertakes to follow optimization guidelines provided by technical assistance when necessary.

Rule 4: Unlimited traffic & security responsibilities

The traffic for all web hosting packages is unmetered, with bandwidth dynamically allocated between clients on the same processing unit. For security reasons, each client has controlled access to the PHP processor. The functions open_basedir, disable_functions and safe_mode (where applicable) are configured to ensure a secure environment. The client undertakes to secure their web applications to prevent unauthorized access based on vulnerabilities. Wingnode cannot be held responsible if the client’s account is compromised. The client is responsible for maintaining their own backups to prevent data loss due to hacks, exploitation or accidental deletion.

Rule 5: Forbidden modules on game servers

The following are not allowed on hosted game servers:

  • Modules that modify performance positively or negatively (timer/booster/fps booster etc.).
  • Modules known for serious security issues (e.g. webmod, hlguard).
  • Modules adding CPU-controlled virtual players (bots).
  • Any abusive methods that modify the player’s client (Slow-Hacking), including CS 1.6 client hacks (GameMenu edits, destroy, autobinds etc.).
    Owners running such extensions or using the service for redirection risk automatic suspension without prior notice.
  • Changing the number of slots beyond the purchased package (including “fake slots”) is forbidden.
  • Clients must optimize their modules/extensions to reduce unnecessary resource usage.
  • The client must not allow other servers to use their sv_downloadurl or expose it publicly.

Rule 6: Right to reject persons

We reserve the right to refuse any person or entity we do not wish to accept as a client, without the obligation to provide justification.

Rule 7: TeamSpeak 3 servers policy

For TeamSpeak 3 services, Wingnode reserves the right to ban rejected users without prior explanation. Administrative ranks may be granted or maintained as needed to enforce these policies. The hosting icon rule: our Wingnode icon must be used and linked/redirected to our official website.

Rule 8: Game hosting resources & support

Wingnode provides clients with the necessary tools for game server management (control panel, FTP access, etc.). The sv_downloadurl (fast download for resources) is offered free of charge for hosted game servers. Technical support for game hosting is free and offered through the forum, Discord or e-mail. We do not provide custom plugin/module development on request.

Rule 10: Invoicing, payment and service suspension

Invoices for services are sent electronically 7 days before the due date. Automatic payment reminders are sent 3 days before the due date. If payment is not received within 3 calendar days after the due date, services may be automatically suspended. Wingnode reserves the right to delete data and reallocate IPs.
A partially paid invoice is not considered confirmed. Services are not extended proportionally for partial payments; the minimum subscription period is 30 days. Any payment made on a billed service, even partially, is non-refundable. Wingnode cannot be held liable if services are suspended due to unpaid or partially paid invoices. After an invoice is fully paid and confirmed, Wingnode undertakes to provide the service, typically within 72 hours.

Rule 11: Backups during suspension

While a service is suspended due to non-payment, the owner has no right to request backup copies of their data.

Rule 12: Accepted payment methods

Available payment methods:

  • Bank transfer to the Serbian bank account displayed on the contact page.
  • Payment methods provided via our local payment partners (where available).

Rule 13: Transfers of services between clients

Any contracted service can be transferred to another client only with the explicit consent of the current owner and Wingnode.
Additionally, the beneficiary undertakes to:

  • Respect Serbian legislation in both letter and spirit.
  • Avoid using our services to publish offensive, abusive or illegal content (forums, blogs, images etc.), including content that violates privacy, encourages illegal activities or infringes copyrights or related rights.
    Service suspension due to violations does not imply partial or full reimbursement of amounts paid. The suspension interval is considered “service provided”. During or after suspension, the provider is not obliged to grant access to any data stored within the contracted service.

Rule 14: Counter-Strike 1.6 & Global Offensive redirection / fake players

Any type of redirection, fake players, bots or similar abuse on CS 1.6 / CS:GO servers may lead to immediate suspension and termination of services.

Rule 15: Prohibited DDoS threats / damaging services

DDoS threats, service damage or malicious activity between customers are strictly prohibited and can lead to suspension and termination of services, without refund.

Rule 16: Prohibited CPU overflow through plugins

Abusive overflow of CPU resources using scripts/plugins is forbidden. Such situations may lead to temporary service suspension until the issue is resolved.

Rule 17: Suspension after payment delay

After a payment delay, Wingnode reserves the right to suspend the product or service at any time.

Rule 18: Service closure after 3 days of unpaid delay

If payment is delayed by more than 3 days after the due date, we reserve the right to permanently close your services, without being required to keep any backups should you later decide to renew.

Rule 19: Right to reject clients and cancel products

We reserve the right to reject customers or cancel any product/service if we decide that continuing collaboration is not in our interest, with or without prior notice.

Rule 20: Excessive Resource Usage & Fair Usage Policy

Wingnode reserves the right to monitor the usage of processing power (CPU), memory (RAM), and network throughput. Any excessive, unnecessary, or artificial loading of resources that jeopardizes the stability of the host node or the performance of other clients is strictly prohibited. This includes, but is not limited to, cryptocurrency mining, stress-testing, or running unoptimized processes intended to saturate system resources. If a user is found to be abusing resources or consistently exceeding fair usage limits, Wingnode reserves the right to permanently terminate the service without prior notice and without any obligation for a refund.

Rule 21: Prohibited Content & Activities on VPS

The following activities are strictly prohibited on our KVM VPS nodes:

  • Email Marketing & Spam: Sending unsolicited emails (SPAM) or hosting mass mailing software is forbidden. Ports related to SMTP may be blocked by default.
  • Scanning & Hacking: Using the VPS for port scanning, IP spoofing, brute-force attacks, or any form of unauthorized access to third-party networks.
  • Malware Hosting: Hosting, distributing, or linking to viruses, malware, or any malicious code.
  • Illegal Content: Hosting copyrighted material without permission (Piracy/Warez), or any content that violates Serbian or International laws.
    Violation of this rule will result in an immediate permanent ban without a refund.

Rule 22: Managed vs Unmanaged Service

All KVM VPS services are Unmanaged. Wingnode is responsible only for the availability of the host node and the network. We do not provide support for:

  • Installing or configuring operating systems beyond the provided templates.
  • Troubleshooting third-party software, scripts, or internal server configurations.
  • Any issues arising from the user’s modification of the kernel or system-level files.

Rule 23: Affiliate & Wallet System

Account credits or wallet balances are non-refundable and cannot be withdrawn as cash. They can only be used to purchase or renew Wingnode services. Any fraudulent activity related to the affiliate system will result in the immediate forfeiture of all earnings and account closure.

Rule 24: Protection of Reputation & Anti-Impersonation Policy

Wingnode maintains a zero-tolerance policy regarding the protection of its brand and professional reputation. Any activity that misuses the Wingnode name to harass or threaten others is strictly prohibited. This includes, but is not limited to:

  • Impersonation: Falsely representing oneself as an employee, owner, or legal representative of Wingnode.
  • Unauthorized Legal Threats: Issuing legal threats, "lawyer letters," or lawsuit notices to third parties (other users, hosting providers, or individuals) while claiming to act on behalf of Wingnode.
  • Brand Damage: Engaging in defamation, spreading misinformation, or any activity intended to tarnish Wingnode’s public image.
  • Staff Harassment: Abusive behavior or threats directed at Wingnode employees via any communication channel.

Any client found using their service (such as a VPS or Web Hosting) to launch their own project while falsely claiming an official partnership or legal affiliation with Wingnode to intimidate others will face an immediate permanent ban. All associated services will be terminated, and data will be deleted without prior notice and without any possibility of a refund.

Rule 25: Unauthorized Network Testing & DDoS Provocation

Wingnode strictly prohibits any form of unauthorized "stress-testing" or network provocations.

  • Strict Prohibition: Clients are forbidden from inviting, hiring, or coordinating third parties to perform DDoS attacks against their own or other servers on our network.
  • Infrastructure Safety: Our protection is for legitimate defense only. Using it as a "testing ground" for DDoS services or intentionally attracting malicious traffic is a severe breach of security.
  • Consequences: Any client found provoking, sharing server IPs for testing purposes, or initiating such attacks will face immediate permanent termination of all services.
  • No Refunds: In cases of network endangerment that affects host node stability or other clients, no refunds will be issued, and the account will be blacklisted.

Rule 26: Free Game Hosting Activity & Resource Policy

In order to ensure optimal resource allocation and maintain service quality, the following rules apply to Free Game Hosting:

  • Automatic Deletion for Inactivity: If a free server is detected as inactive for a period of at least 7 days, it will be automatically deleted without prior notice to allow other users to claim the free resources.
  • Resource Prioritization: Wingnode reserves the right to terminate or delete free services at any time, without notice, if resources are required for paying customers or to maintain overall node stability.
  • No Data Guarantee: Once a server is deleted for any of the above reasons, all data is permanently lost. Wingnode does not provide backups or data recovery for free services.

Rule 27: Mandatory Advertisements & DDoS Protection

As Wingnode provides high-level G-Core DDoS protection even for free plans, the following advertisement policy is enforced:

  • Automatic Advertisements: Most current free game servers (and all in the near future) will include automatic hosting advertisements (e.g., chat messages, hostname tags, or banners).
  • Fair Use Agreement: By using the free service, the client accepts these advertisements as a fair exchange for the enterprise-grade protection and resources provided.
  • Removal Policy: If a client wishes to remove advertisements, they must open a support ticket to discuss available options or upgrades.

Rule 28: Windows Server Licensing & Installation Fees

For services requiring a Windows Server operating system, the following specific terms apply:

  • Installation Fee: A one-time setup fee of 59.99 applies to all Windows Server installations. This fee is non-refundable and covers the initial deployment and environment preparation.
  • Trial Licensing: Wingnode provides a free evaluation license for Windows Server valid for an initial period of 6 months.
  • License Extension: Clients are eligible for a license extension for an additional 6 months (totaling 12 months), provided the service remains active and all invoices are paid on time during the initial period.
  • Post-Trial Responsibility: After the expiration of the evaluation period(s), the client is responsible for providing their own valid license or migrating their data. Wingnode is not liable for service interruptions caused by the expiration of evaluation licenses.
  • Resource Management: Due to the higher overhead of Windows OS, clients are prohibited from running nested virtualization or heavy background indexing services that negatively impact the host node's storage I/O.
  • Prohibited Software: Running Android emulators (e.g., BlueStacks, Nox) or automated browser farms on Windows VPS instances is strictly forbidden as they bypass fair-usage CPU limits.
  • Update Policy: The client is solely responsible for managing Windows Updates. Wingnode is not responsible for data loss or service downtime caused by automatic OS restarts or failed updates.

Rule 29: Jurisdiction & Legal Compliance

These Terms of Service are governed by the laws of the Republic of Serbia. Any legal disputes shall be resolved within the jurisdiction of the competent courts in Serbia. Wingnode reserves the right to cooperate fully with law enforcement authorities in any official investigation regarding illegal activities performed through our services.

Rule 30: Wingman AI Usage & Limitation of Liability

Wingman AI is an automated assistant designed to help clients manage their game servers and files. By using this service, the client acknowledges and accepts the following:

  • AI Limitations & Errors: We are actively working to minimize errors, but due to the complexity of game server environments, we cannot guarantee that the AI will not make mistakes. Wingnode is not liable for any incorrect configurations, server downtime, or issues caused by AI-generated responses.
  • Third-Party Dependencies: Wingman AI relies on external infrastructure (Anthropic). We cannot be held reliable if their servers are overloaded, under maintenance, or rejecting prompts. We have no control over these external outages and are not responsible for service delays during such periods.
  • Restricted Actions (No Deletion): For maximum security, Wingman AI is strictly prohibited from deleting files or folders. The AI can only create new files or edit existing ones. Any requirement for file deletion must be performed manually by the user.
  • Backups: For safety, the system automatically stores the last 5 versions of any file modified by the AI. However, the client is still responsible for maintaining their own independent backups.
  • Free Trial & Eligibility: Every client receives 5 free prompts (up to 75,000 tokens) upon registration, excluding Free Game Hosting users. Free hosting users do not have access to Wingman AI.
  • Billing: After the free trial, Wingman AI is charged per prompt. Credits spent are non-refundable, except in cases of internal system errors where the prompt was not processed.
  • Right to Temporary Suspension: Wingnode reserves the right to temporarily suspend Wingman AI services at any time and without prior notice for urgent security patches, exploit mitigation, or scheduled system updates. Such suspensions are necessary to protect the integrity of user data and infrastructure. These service interruptions do not entitle the user to any refunds or compensation.
    • Maintenance & Notifications: Wingnode will strive to announce any scheduled maintenance or updates for Wingman AI in advance through the official Discord server and/or via email.
  • Emergency Suspension: In cases of critical security vulnerabilities, mass abuse attempts, or urgent infrastructure repairs, Wingnode reserves the right to suspend Wingman AI services instantly and without prior notice. The security of user data and network stability takes absolute precedence over the availability of the AI assistant.

Rule 31: Monitoring, Jailbreaking & Intellectual Property

To ensure the safety of our infrastructure, Wingnode performs active monitoring of all prompts sent to Wingman AI.

  • Jailbreak Policy: Any attempt to "jailbreak," bypass safety filters, or manipulate the AI into performing unauthorized actions—whether successful or not—will result in the permanent termination of Wingman AI access for that user without a refund.
  • Reverse Engineering: Any attempt to extract the "System Prompt," internal logic, or instructions of Wingman AI is considered a theft of intellectual property and will result in immediate termination of access.
  • Account Termination: If a user successfully bypasses AI restrictions to access sensitive data, harm the infrastructure, or violate security protocols, the user’s account and all associated services will be terminated immediately without prior notice and without any possibility of a refund.
  • User Responsibility: Any action triggered by the user via Wingman AI is considered user-authorized. Wingnode will not be held responsible for the outcome of these actions.

Rule 32: Budget VPS Services

Wingnode offers "Budget VPS" plans as a reseller of third-party infrastructure. By purchasing these services, the client acknowledges and accepts the following specific conditions:

  • Third-Party Infrastructure: Budget VPS services are provided through an external partner. Wingnode does not have direct control over the hardware, physical host nodes, or the upstream network.
  • Uptime & Security Liability: Since these services are provided by an outside firm, Wingnode cannot be held liable for any downtime, network instability, or the effectiveness of DDoS mitigation.
  • Service Performance: Budget services are for users with limited budgets. The client acknowledges that performance and protection levels are lower than Wingnode’s Premium services.
  • Support & Issue Forwarding: In case of a problem, Wingnode can only forward the report to the provider. The resolution time is beyond our control and scope.
  • Technical Responsibility: Wingnode is not responsible for troubleshooting software, operating systems, or internal configurations on these instances.
